About These Terms
- These Terms and Conditions ("Terms") govern your access to and use of the services offered by Tonim Wayfinding (ABN: 78 214 664 474), operated by TonimTrust ("Tonim Wayfinding", "we", "us", or "our"), based in Melbourne, Victoria, Australia.
- By engaging our services, making a booking, or purchasing any product or program, you ("Client", "you", or "your") agree to be bound by these Terms. Please read them carefully before proceeding.
- These Terms comply with the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law and Fair Trading Act 2012 (Vic), and all applicable Victorian consumer protection legislation.
Our Services
Tonim Wayfinding offers services across four key areas:
2.1 Travel Advisory Services
Travel planning consultation and itinerary design
Cruise travel advisory, including cruise bookings and port guidance
Travel agent services (bookings made on your behalf)
Online travel content including YouTube port guides and blog resources
Affiliate product recommendations
In-person workshops covering mindfulness journaling, art journaling, and creative practices
Workshop series, masterclasses, and one-off sessions
Physical journaling products including journals and prompt card packs
One-on-one transformational coaching (NLP-certified)
Group coaching programs and online courses
Retreats (where offered)
Asset management, service planning and review, and corporate strategy consulting
Odoo ERP implementation and configuration
Process improvement and business advisory
Workshop and event bookings: Payment in full at time of registration unless otherwise stated
Coaching packages: Deposit required to secure commencement; balance per agreed schedule
Retreat bookings: Deposit required; final payment due no later than [X] days prior to commencement
Consulting engagements: As set out in the relevant Service Agreement
Physical products: Payment in full at time of order
Cancellation more than 14 days before the event: Full refund or credit note at your discretion
Cancellation 7–13 days before the event: 50% refund or full credit note
Cancellation fewer than 7 days before the event: No refund; credit note may be offered at our discretion
Non-attendance without notice: No refund or credit
Cancellation more than 60 days before retreat commencement: Full refund less non-refundable deposit
Cancellation 30–60 days before retreat: 50% refund of amount paid above deposit
Cancellation fewer than 30 days before retreat: No refund; transfer to a future retreat at our discretion
You are responsible for your own decisions, actions, and outcomes
You will engage honestly and in good faith
You will notify your coach if you are working with a mental health professional, so coaching support can be appropriately tailored
You understand that results are not guaranteed and depend significantly on your own commitment and effort
Step 1: Contact us in writing at [email]. We will acknowledge your complaint within 5 business days and aim to resolve it within 14 business days.
Step 2: If we are unable to resolve your complaint to your satisfaction, you may refer the matter to Consumer Affairs Victoria (1300 558 181 | consumer.vic.gov.au) or the Australian Competition and Consumer Commission (ACCC).
Step 3: If the dispute remains unresolved, either party may refer it to mediation before commencing legal proceedings.

Service availability may vary. Tonim Wayfinding reserves the right to modify, suspend, or discontinue any service with reasonable notice.
3. Booking and Engagement
3.1 How to Book
Bookings may be made via our website, email, or other approved channels. A booking is confirmed only upon receipt of written confirmation from Tonim Wayfinding and payment of any required deposit or full fee as applicable.
3.2 Service Agreements
For coaching, consulting, and retreat services, a separate Service Agreement or Client Agreement may be required before work commences. No consulting or coaching engagement will begin without a signed agreement in place.
3.3 Accuracy of Information
You agree to provide accurate, current, and complete information when booking or engaging our services. Tonim Wayfinding accepts no liability for outcomes arising from inaccurate information provided by you.
4. Fees and Payment
4.1 Pricing
All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Prices are subject to change, but confirmed bookings will be honoured at the price agreed at time of booking.

4.4 Late Payment
Where payment is not received by the due date, Tonim Wayfinding reserves the right to suspend service delivery until payment is received, without penalty to us.
5. Cancellation, Refunds, and Rescheduling
Your rights under this section are in addition to, and do not limit, your rights under the Australian Consumer Law.
5.1 Client-Initiated Cancellation — Workshops and Events
5.2 Client-Initiated Cancellation — Coaching Programs
Where a coaching package has commenced, refunds will be calculated on a pro-rata basis for any sessions not yet delivered, less a reasonable administration fee. Requests must be made in writing.
5.3 Client-Initiated Cancellation — Retreats
Retreat deposits are non-refundable in all circumstances as they are used to secure venue and supplier commitments.
5.4 Tonim Wayfinding-Initiated Cancellation or Changes
We reserve the right to cancel or reschedule any event, workshop, or session. Where we cancel an event entirely, you will receive a full refund of amounts paid. Where we reschedule, you may elect a refund or transfer to the new date. We accept no liability for travel, accommodation, or other costs incurred by you in connection with a cancelled or rescheduled event.
5.5 Travel Bookings
Cancellation and refund terms for travel bookings (flights, cruises, accommodation, tours) are governed by the terms and conditions of the relevant travel supplier or airline. Tonim Wayfinding will assist in processing any applicable refund requests but is not liable for supplier cancellation fees or non-refundable components.
6. Australian Consumer Law — Statutory Guarantees
Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law, including the consumer guarantees that cannot lawfully be excluded.
Under the ACL, you are entitled to a replacement, repair, or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services re-supplied if they are not supplied with due care and skill or are not fit for purpose.
To the extent permitted by law, our liability for any failure to comply with a consumer guarantee in relation to services not ordinarily acquired for personal, domestic, or household use is limited to: (a) re-supplying the services; or (b) payment of the cost of having the services supplied again.
7. Coaching Services — Specific Terms
7.1 Nature of Coaching
Coaching provided by Tonim Wayfinding is a professional development and personal growth service. It is not counselling, psychotherapy, psychological treatment, or medical advice. Coaching is not a substitute for professional mental health treatment.
If you are experiencing a mental health crisis, please contact Lifeline (13 11 14), Beyond Blue (1300 22 4636), or your GP or mental health professional.
7.2 Your Responsibilities as a Coaching Client
7.3 Confidentiality
All information shared in coaching sessions is treated with strict confidentiality. Exceptions apply only where: (a) you consent to disclosure; (b) disclosure is required by law; or (c) there is a serious and imminent risk of harm to you or another person.
7.4 Session Attendance and Lateness
Sessions cancelled by you with less than 24 hours notice, or where you do not attend, will be forfeited without refund. If you are more than 15 minutes late, the session will be deemed a no-show unless prior arrangements have been made.
8. Retreats — Specific Terms
8.1 Participant Responsibilities
You are responsible for ensuring you are physically and mentally fit to participate in retreat activities. You must disclose any health conditions, dietary requirements, or mobility limitations at the time of booking.
8.2 Travel and Accommodation
Unless expressly stated, retreat fees do not include travel to or from the retreat venue. You are responsible for arranging and funding your own travel. We strongly recommend travel insurance.
8.3 Travel Insurance
Tonim Wayfinding strongly recommends that all retreat participants obtain comprehensive travel insurance, including coverage for trip cancellation, medical expenses, and loss of personal belongings. We accept no liability for incidents covered by travel insurance that you have elected not to obtain.
8.4 Conduct
All participants are expected to treat fellow participants, facilitators, and venue staff with respect. Tonim Wayfinding reserves the right to remove any participant whose behaviour is disruptive or harmful to the experience of others, without refund.
9. Travel Advisory Services — Specific Terms
9.1 Travel Agent Services
Where Tonim Wayfinding acts as your travel agent, we act as an intermediary between you and travel suppliers (airlines, cruise lines, hotels, tour operators). All bookings are subject to the terms and conditions of the relevant supplier.
9.2 Travel Information and Content
Travel information, port guides, YouTube content, and blog posts published by Tonim Wayfinding are provided for general informational purposes only. Conditions at destinations change frequently. You should verify all information independently before travelling.
9.3 Affiliate Links
Some of our content may include affiliate links, meaning we may receive a commission if you purchase through those links. This does not affect the price you pay. We only recommend products and services we genuinely believe in.
9.4 Passports, Visas, and Entry Requirements
You are solely responsible for ensuring you hold the correct travel documents, passports, visas, and vaccinations required for your trip. Tonim Wayfinding accepts no liability for any loss arising from failure to hold required documentation.
10. Physical Products
10.1 Orders
Product orders are confirmed upon payment. We reserve the right to refuse or cancel any order, with a full refund in such circumstances.
10.2 Delivery
Estimated delivery times are indicative only. Tonim Wayfinding is not responsible for delays caused by postal services or customs. Risk of loss passes to you upon dispatch.
10.3 Returns and Defective Products
If a product is faulty or not as described, you are entitled to a remedy under the Australian Consumer Law. Please contact us at [email] within 14 days of receipt. Change-of-mind returns are accepted within 14 days where the product is unopened and in original condition, subject to a return postage cost borne by you.
11. Intellectual Property
All content created by Tonim Wayfinding, including but not limited to course materials, workbooks, journaling prompts, coaching frameworks, website content, YouTube videos, and blog posts, is the intellectual property of Tonim Wayfinding and is protected by Australian copyright law.
You may use materials provided to you for your own personal use only. You may not reproduce, distribute, adapt, or share our materials without prior written consent.
12. Privacy
We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy, available at tonimwayfinding.com/privacy, explains how we collect, use, disclose, and store your personal information and how you can access, correct, or make a complaint about how we handle it.
13. Limitation of Liability
To the maximum extent permitted by law, Tonim Wayfinding's total liability to you for any claim arising from or in connection with our services is limited to the amount paid by you for the relevant service.
Tonim Wayfinding is not liable for any indirect, consequential, special, or incidental loss or damage, including loss of income, loss of opportunity, or emotional distress, except where such liability cannot be excluded under the Australian Consumer Law.
Nothing in these Terms limits your rights as a consumer under the Australian Consumer Law.

These Terms are governed by the laws of Victoria, Australia. You consent to the exclusive jurisdiction of the courts of Victoria for any dispute arising under these Terms.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be published on our website with a revised effective date. Continued use of our services after a change constitutes acceptance of the updated Terms. For existing coaching or consulting engagements, changes will not apply retrospectively.
